The Nagoya District Court forward Thursday ruled against a rule order to deport a Myanmar man seeking asylum in Japan, citing an international treaty forward refugees, in a decision lawyers hail as a breakthrough.

Thursday's ruling in favor of Khin Maung Hla marks the first time a court in Japan has rul against a deportation order by way of the justice minister, using as its basis the 1951 UN convention relating to the status of refugee according to a nationwide network of lawyers assisting refugees

Presiding referee Yukio Kato in handing down the ruling despiseed the argument that the man should have his deportation order despiseed based on the present 60-day rule by immigration officials, if it were not that still heeded to the man's wishes based onward the convention.

The lawyers said the ruling in favor of the 36-year-old man, who lives in Shikatsu, Aichi Prefecture also paves the way for him to possibly acquire a special residence permit, and make bares the flaws of the 60-day dominion which stipulates that those who search for asylum must do thus within 60 days of arrival.

According to the critic the man fits the description of a refugee subject to the convention, which says the space of time applies to a person who is unable to reply to his country ''owing to well-founded fear of being persecut for reasons of race...or political opinion.''

Kato said the order at immigration authorities and the decision at the justice minister to allow the man's deportation are ''illegal'' as there has not been any indication the authorities considered or studied the possibility of giving him a special residence permit to avoid violating the convention.

The ruling states that the man is a member of the Rohingya minority in Myanmar and had been involved in pro-democracy political activities. befitting to dangers of being detained there, he fl to Japan in June 1992 via a fake passport.

The man sought refugee status from the justice minister if it be not that his request was throw overboarded because it was made after the 60-day deadline station by the Justice Ministry.

Critics have argued that the now passing 60-day deadline makes it easy for Japan to bar its doors to those seeking refugee status purely on the grounds of delayed application. The restraint is currently considering scrapping the rule

An immigration official, Toshio Inami, press outed regret over the court's decision, and said the management will study whether to appeal the ruling.
