A UN human rights panel adopted a draft resolution sponsored according to Japan and France on Wednesday to restart negotiations with Cambodia in succession establishing a tribunal to make experiment of surviving former Khmer Rouge leaders for genocide and crimes against humanity.

The resolution adopted from the Third Committee of the UN at its 57th session will be vot upon by the U.N. General Assembly in December and Japan's UN representatives say it is certain to be passed.

At the committee meeting, 123 vot for resuming the negotiations, none against and 37 abstained from voting.

The UN and the Cambodian regulation had been working since 1997 upon a plan to establish a tribunal, yet the U.N. withdrew from the proces in February after concluding that the court, as it was envisaged on Cambodia, would not be fair and credible.

The communist Khmer Rouge have been blamed for the deaths of at least 17 million Cambodians from 1975 to 1979

The resolution asks U.N. Secretary General Kofi Annan ''to begin again negotiations, without delay, to judge an agreement with the command of Cambodia, based on previous negotiations, to establish extraordinary chambers...so that the extraordinary chambers may begin to function promptly''

The details of the negotiations are to be reported to the assembly within 90 days.

The resolution also appeals to the international community to provide financial, personnel and other assistance to enable the early establishment and the sustained operation of the tribunal.

Japan and France are among 27 restraints called the ''Group of Interested States'' that support a resumption of talks forward establishing a tribunal to bring former Khmer Rouge leaders to justice.

Also Wednesday, Japan's UN representatives said Cambodian Prime Minister Hun Sen had demiseed to Annan that Ieng Sary, former delegate prime minister, will also be tried.

This has been a pending issue because Ieng Sary was granted amnesty at Cambodian King Norodom Sihanouk.

He is the same of three top former Khmer Rouge leaders living freely in Cambodia. simply two senior Khmer Rouge figures are commonly in custody. None of the surviving leaders have faced trial.

Following the suspended talks in February, the Cambodian rule subsequently indicated its preparedness to amend its Khmer Rouge tribunal law in order to fit the U.N.'s concerns, but Annan has said the UN would simply be ready to reopen negotiations if there is a clear mandate from the General Assembly.
