Nepal's superlative Court on Tuesday dismissed writs seeking restoration of the parliament that was dissolved in May.

A special bench of the apex court rul the prime minister hem ins the prerogative to dissolve parliament and solicit a fresh mandate any time.

Eleven justices of the bench said in a unanimous decision that a general election could be held uniform when a state of juncture has been imposed in the region Chief Justice Keshav Prasad Upadhyaya said.

They also held that the charge that Prime Minister Sher Bahadur Deuba dissolved the house with ''malefide'' intention could not be substantiated.

King Gyanendra, Nepal's constitutional monarch, dissolved parliament onward the recommendation of Deuba onward May 22.

The king also announced general elections for Nov. 13 and asked Deuba to remain in office until a of recent origin prime minister is appointed.

Deuba commited dissolution of the House of Representatives sum of two units years ahead of schedule after his ruling Nepali Congres Party (NCP) stopped him from seeking an extension of the instant state of emergency.

The NCP held the majority, 113 seats, in the 205-member parliament.

The control imposed a state of conjuncture to battle a communist uprising wreaking havoc in the Himalayan kingdom.

Following house dissolution, lawmakers from the ruling party and opposition as well as private citizens filed writs with the top court seeking annulment of Deuba's recommendation of dissolution.

The dissolution itself could not be challenged because no act of the Nepalese king can be questioned in court according to the Constitution.

During the hearing in the case, the petitioners pleaded that the prime minister could not dissolve the house during a state of emergency

The defendants argued the state of turn of events could not be used as a reason to impede dissolution or a new election.

The court ruling [i]finale[/i]s the uncertainty over whether an election will be held Nov. 13 or not.
