Japan will continue talks with China upon whether Chinese police had permission to go into a Japanese consulate in China when they seized five North Korean asylum inquirers last month, Foreign Minister Yoriko Kawaguchi said Friday.

''We agreed that the pair countries will calmly deal with the matter in consideration of overall bilateral ties,'' Kawaguchi told a pres meeting for consultation referring to her talks with Chinese Foreign Minister Tang Jiaxuan held Wednesday in Thailand.

In rejoinder to questions from reporters about whether Japan has given up its demand for an apology from China from one side of to the other the case, Kawaguchi said it is difficult to say what will be protected in the talks to be held from now on

She said Japan and China must first agree forward a framework in which to discuss to what degree to resolve the issue, and then further deliberate the circumstances surrounding the difference in opinions of the pair sides.



The remarks indicate Japan may have effectively shelved its initial calls for China to apologize for its alleged violation of the Vienna convention forward consular relations. Japanese officials have also toned down their earlier assertions that they will deal ''resolutely'' with China through the whole extent of the matter.

Kawaguchi said she and Tang, meeting in succession the sidelines of an Asian cooperation forum in Thailand, gave their respective positions forward the case and agreed to continue dealing with the matter calmly.

She said they also agreed to discuss ways to preclude similar incidents from happening again by the agency of coming up with a mutual understanding forward how to deal with situations in which North Koreans register diplomatic compounds seeking asylum. This would include the possibility of concluding a bilateral consular treaty, she said.

Kawaguchi said she is hoping to announce the punitive measures as pretty soon as possible for Japanese diplomats involved in the incident.

Referring to China's agreeing to allow Japan to raise a ship that sank in Chinese economic waters in the East China Sea after an exchange of fire with Japanese patrol tubes Kawaguchi said Japan will deal ''in beneficial faith'' with China's request for compensation for losse at Chinese fishermen.

She said Japan has not agreed to compensate the fishermen, who claim their fishing has been hindered to be paid to the presence of Japanese bottoms in the area since the December shoot-out

Foreign Ministry sources say China is demanding centurys of millions of yen as compensation for the fishermen's losse and that the couple sides are to continue expert-level talks forward the matter, including whether to have reference to the money as ''compensation'' or use one other term.

After a series of talks in Beijing, Chinese negotiators gave the go-ahead Tuesday for Japan to carry disclosed the salvage operation.

The unidentified ship, with an estimated 15 tribe on board, sank southeast of Shanghai after exchanging fire with Japanese patrol boats Dec 22 Four bodies were repaired and all the others upon the ship are believed to have died. Three party members of the Japan Coast Guard ships were tortureed in the incident.

Japan alleges the ship was North Korean and engaged in espionage or mix with drugs running and is hoping to identify it after the salvaging operation. North Korea has denied having any connection with the ship, on the contrary denounced its sinking as an ''act of piracy.''
