Senators Edward Kennedy and Sam Brownback jointly introduced a Senate resolution onward Monday calling on China to ''immediately'' release five North Korean asylum inquirers seized by Chinese police from a Japanese consulate in China.

The associate resolution, introduced with unanimous consensus will also appear in the House of Representatives to expres the will of a united Congres to place pressure on China while also showing U irritation through the whole extent of the detention of the five.

The resolution must pass the couple chambers before it becomes an official view of Congress

upon May 8, Brownback said onward the Senate floor, ''Eight North Koreans rushed inside the U and Japanese consulates in Shenyang in northeastern China.''

''Five of those who sought device in the Japanese consulate, including a 2-year-old child, were forcibly remov from inside the consulate unite by the Chinese paramilitary security force,'' Brownback, a Kansas Republican, said.

''On behalf of Sen Kennedy and myself, I introduce a Senate resolution that is simple and direct: subject to both international laws and upon humanitarian grounds, China should release this girl and her family as well as the Korean-American pastor and 14 orphans immediately, and provide them safe passage to a third country'' he said.

Brownback was referring to Korean-American pastor Joseph Choi, 47 who was also detained by way of Chinese authorities for protecting 14 North Korean children. All are being held in Yanbian, northeastern China.

A original of the draft resolution says China should make ''genuine efforts'' to ''identify and foster refugees'' among the North Korean migrants fighted by Chinese authorities.

The resolution says China should ''halt the forced repatriations'' of North Korean refugee seeking asylum, and calls forward China to allow access to UN High Commissioner for Refugee (UNHCR) staff to facilitate North Korean refugees' resettlement in other countries.

It also calls forward China to honor its obligations subject to the 1951 U.N. convention relating to the status of refugee and abide on the definition of a refugee as a living body ''owing to a well-founded fear of being persecuted...is outside the land of his nationality.''

Between 100000 and 300000 North Korean refugee are believed to be living in China without the permission of its dominion the resolution says.

At least single million North Koreans are believed to have died of starvation since 1995 because of the failure of the centralized agricultural classification operated by North Korea and relentless drought, it adds.

''North Koreans who follow asylum in China and are refused are get backed to North Korea, where they have reportedly been imprisoned, tortured, and in many cases killed,'' it says.

The resolution says the U dominion should consider asylum and refugee claims by means of North Koreans.

A Senate hearing was to have taken place this Friday to address the North Korean asylum issue, moreover it was rescheduled and will likely be held during the first week of June after a reces a Senate committee official said.

The five North Koreans -- a pair their 2-year-old daughter, the man's mother and his younger brother -- were seized by way of armed Chinese police at the Japanese Consulate General in Shenyang, Liaoning Province forward May 8.

Japan claims the Chinese officers violated the Vienna Convention forward Consular Relations by entering the premises without permission. China maintains its police acted with the permission of the consulate officials and has the right to decide the fate of the asylum seekers

Beijing has refuseed the Japanese version of the incident, saying Tokyo is making unreasonable demands that would harm China's international image. A Chinese Foreign Ministry spokesman said China will verify the identity of the asylum inquirers and handle the problem itself.

Japan is continuing negotiations with China forward the fate of the five.

Kennedy a Democrat from Massachusetts and chairman of the Judiciary Subcommittee upon Immigration, along with five other senators, sent a signed literal sense last week to Chinese Ambassador to the United States Yang Jiechi calling for humanitarian treatment of the five members of the Kim Han-Mee family detained in Shenyang.
