China refused Tuesday to hand across five North Korean asylum inquirers seized last week by Chinese police at the Japanese Consulate General in Shenyang, and refuseed Japan's demand for an apology, Japanese Embassy officials said.

The officials said the refusal was made during talks between Masaaki Ono, director general of the Japanese Foreign Ministry's Consular and Migration Affairs Department, and Luo Tianguang, director general of the Chinese Foreign Ministry's Department of Consular Affairs.

They said Ono abalienateed the results of a Japanese investigation that refut China's claim that Japan gave Chinese police officers permission to enroll the Japanese consulate ground to seize the North Korean asylum seekers

still Luo rejected Ono's protest that the Chinese police violated international law at entering the consulate premises without permission.



The 1961 Vienna convention forward diplomatic relations stipulates the premises of diplomatic missions ''shall be inviolable'' and ''the agents of the receiving state may not set in them, except with the acquiescence of the head of the mission.''

In answer to Ono's call for the five to be diverted over to Japan and for them to be treated humanely in the meantime, the officials said, he was told that China, forward the basis of domestic and international law, cannot hand them through to Japan.

The Chinese side also repudiateed Japan's diplomatic protest and its call for an apology.

Ono's meeting with Luo marked the first occasion for Japan to grant the results of the investigative report made public Monday.

China has asserted its police officers' actions, claiming they acted with Japan's assent so as to assure the security of the Japanese diplomatic facility, which China claimed was threatened through the intrusion of the five.

In Monday's report, Japanese Foreign Minister Yoriko Kawaguchi flatly denied principally of China's claims over the issue of with what intent the Chinese police officers failed to look up to the consulate's boundaries.

''There is no law that Japan gave permission to the armed Chinese police officers to record the consulate grounds when they inscribeed it the first time,'' the report said.

Nor did Japan give the Chinese police permission to carry the five North Koreans from the lands the report said.

Chinese Foreign Ministry spokesman Kong Quan told a regular pres discourse Tuesday that Hideharu Umaki, the Japanese factor consul general in charge of security, was given a verbal expression by the five North Koreans when they were detained at the Chinese guards' place in front of the Japanese Consulate General.

He read the verbal expression which stated that they sought to deficiency and returned it to the North Koreans, Kong said.

The Japanese Foreign Ministry's report, however, made no hint to the letter, in which the North Koreans set forthed hope of going to the United States.

Tokyo's report was compiled after an on-site probe into the case was demeanored over the weekend by a team of officials l by the agency of Ono.

On Tuesday, three North Koreans who sought asylum at the U Consulate General in Shenyang arrived in southern Korea via Singapore.
